Terms of Service

These Terms of Service ("Terms") govern your use of the CouchRot mobile application (the "App") operated by CouchRot ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

CouchRot is an AI-powered movie and TV show recommendation app. The App provides personalized recommendations, a personal vault for tracking ratings, a watchlist, community-driven ratings (the "CouchRot Score"), and social features for connecting with friends. Some features require a paid subscription ("Premium").

2. Eligibility

You must be at least 13 years old to use CouchRot. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to use only one account per person and to provide accurate information when creating your account. Your username is permanent and cannot be changed after registration.

You must notify us immediately at support@couchrot.app if you believe your account has been compromised.

4. Subscriptions and Billing

CouchRot offers a free tier with limited features and a Premium subscription with expanded capabilities. Premium subscriptions are managed and billed through the Apple App Store.

  • Subscription prices are displayed in the App and may vary by region.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your Apple ID account settings.
  • Refunds are handled by Apple in accordance with their App Store refund policies. We do not process refunds directly.

5. User Content

"User Content" includes your movie and TV show ratings, watchlist entries, and any other content you submit to the App. You retain ownership of your User Content.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, aggregate, and display your ratings as part of the CouchRot Score and other community features. Individual ratings may be visible to your friends within the App. Aggregated scores are anonymous and may be displayed publicly.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to other users' accounts or data
  • Scrape, crawl, or use automated tools to extract data from the App
  • Interfere with or disrupt the App's infrastructure
  • Submit fraudulent ratings or manipulate the CouchRot Score
  • Create multiple accounts to circumvent free-tier limitations

7. Intellectual Property

The CouchRot name, logo, "CouchRot Score," app design, and all related branding are the intellectual property of CouchRot. You may not use our trademarks, logos, or branding without prior written permission.

Movie and TV show metadata, posters, and streaming availability information displayed in the App are provided by third-party data sources and remain the property of their respective owners.

8. AI-Generated Recommendations

Recommendations provided by CouchRot are generated by artificial intelligence and are for entertainment purposes only. We do not guarantee the accuracy, quality, or suitability of any recommendation. Streaming availability may change at any time and may not reflect real-time availability on all platforms.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COUCHROT, ITS OWNER, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless CouchRot and its owner from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account at our sole discretion if we believe you have violated these Terms. You may delete your account at any time from the Settings screen in the App. Upon termination, your right to use the App ceases immediately and your data will be permanently deleted.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
